Disputes

Sometimes the racing dream doesn't go to plan, and help and advice to resolve a situation might be required. The ROA team can signpost help and impartial advice in confidence. 

Some disputes may need an initial conversation with a solicitor. A list of solicitors who are experienced in racing and bloodstock matters can be found here:

A dispute with your trainer

The ROA/NTF Training Agreement includes a section on the resolution of disputes (Clause 18-20).

Clause 19 of the ROA/NTF training agreement makes provision for an owner/trainer to pay a disputed sum into a joint account at Weatherbys controlled by the ROA and NTF.

The money is held until the dispute is resolved. Payment into the account permits an owner to remove their horses from a trainer's yard whilst giving the trainer comfort that there are cleared funds available to settle the debt or the part of the debt that it is eventually agreed should be paid.

 

ROA / NTF Joint Holding Account

The ROA and NTF have agreed a set of simple terms and conditions as follows:

1. ROA/NTF Joint Holding Account.

Purpose of Account

2. To provide an account for use pursuant to clause 21 of the ROA/NTF standard training agreement, being an account into which an owner in dispute with a trainer can pay the amount claimed by the trainer, such money to be held on the basis set out below:

3. Money is accepted into the account on the basis that it is cleared funds of the owner concerned.

4. The money will be held in the Account by the ROA and NTF as stakeholder until resolution of the dispute between the trainer and the owner.

5. Any interest shall be credited to the capital but the ROA or the NTF shall be entitled to deduct a reasonable administrative charge from any such interest

6. Details of the rate of interest applicable to the account can be obtained from the ROA or the NTF. There is no obligation upon the ROA or the NTF to monitor the rate of interest payable nor to seek better rates of interest.

Payment of money from the Account

7. Funds can only be withdrawn from the account on the joint signatories of authorised officers of the ROA and the NTF.

8. Funds will only be paid out on the written authority of both parties to the dispute or their legal advisers or in accordance with a court or consent order. The ROA and the NTF reserve the right to ask for further evidence of agreement or authority to instruct if not satisfied with the instructions received.

Liability

9. No liability shall attach to the ROA or the NTF or any officers of either association for any loss occasioned to any party arising out of the use of the ROA/NTF Joint Holding Account.

In the excitement of the day the race itself may have passed in a blur. Where can you go if you want to review your horse's race in the form of racing replays? 

Unfortunately, there is no free, one-stop-shop answer. How you can access a race depends on the course you have run at. Here is our handy guide to racing replays: 

At The Races

In spite of the change over to Sky Sports Racing, replays are still available on the old At The Races platform. However, replays of Irish races are no longer archived.

Going to the Sales

Going to the sales is exciting, but can also be a bewildering experience. 

We have asked a few of the professionals for some handy tips when venturing to the sales ring planning to buy a horse for the first time.

Owners will most often be guided by their trainer when purchasing a horse. 

Breeze Up tips for Owners

These unique sales for two-year-olds give prospective purchasers the chance to see a horse breeze (gallop) over a couple of furlongs, either live or online, before the sale.

Ed Sackville, bloodstock agent and co-partner at Sackville Donald suggests the following helpful advice for owners heading to the breeze-up sales.

  • Timing the horses certainly gives you an advantage, however, don’t be entirely dependent on the clock - Dante winner and Derby second Libertarian did a below average time when he breezed.
  • Make sure you take into account what the going is when a horse breezes.
  • At the breeze-ups it is often worth getting horses vetted as some of them may have been put under plenty of pressure in the previous months.
  • Once you have bought a horse, don’t think that it is going to be instantly ready to run just because the day beforehand you saw it gallop two furlongs. Sometimes giving the horse a break does the world of good.
  • If you can, look at the horse before and after it breezes.

Other Sales

Throughout the year there are a number if sales which covers horses in various stages of development; foals, yearlings, horses in training. These horses will not breeze beforehand, but are available of inspection. What is the best way to approach any sale?

Anthony Bromley, co-director of Highflyer Bloodstock, suggests the following tips when buying horses at the sales:

  • Don't work alone. Having the opinion of a bloodstock agent who understands the market as well as the racehorse trainer who will train the horse is invaluable. Apart from their expert advice it is always good to have a second/third opinion on any purchase in life.

  • Discuss your budget prior to going into the sales ring and try to stick to it. Remember the race is out on the racecourse and there are no prizes for being first at the auction.

  • Make sure you watch him/her again in the pre-sales ring before you bid. By then your conformation notes should all be complete, and this last look is to ensure you are happy that the horse is coping with the occasion mentally.

  • You don't have to be a fashion follower. In the vast majority of cases a stallion's first crop of foals are by far the most expensive he will ever have. A first-season sire is very popular because no one has bought or trained a loser by him yet! That situation will soon change.

  • Don't go for a drink in the bar until after you have bought your horse!
